Terms and Conditions of Sale

These Terms and Conditions of Sale govern the purchase of products on the website www.smokingb2b.it.

Placing an order through the website implies the acceptance of these conditions of sale. King S.r.l. reserves the right to modify these conditions at any time. The applicable conditions are those published on the website at the time the order is placed.

1. Products

The products published on the website are described in their respective product sheets. Images are for illustrative purposes and may differ from the product actually delivered in terms of packaging, graphics, color, or other non-substantial elements.

King S.r.l. undertakes to update the information on the website, but does not guarantee that descriptions, images, or availability are always free of material errors.

2. Products subject to sale restrictions

The sale of electronic cigarettes, inhalation liquids, products containing nicotine, and products subject to special regulations is permitted exclusively within the limits provided by law.

The Customer declares to be of legal age and to provide true, complete, and updated information.

King S.r.l. reserves the right to request additional documentation, verify the data provided, and refuse or cancel orders if the requirements provided by the applicable regulations are not met.

3. Prices

The prices of the products are those indicated on the website at the time the order is placed.

Any taxes, duties, shipping costs, payment fees, or other ancillary costs are indicated in the order summary before final confirmation.

King S.r.l. reserves the right to change prices at any time. Any changes do not apply to orders already confirmed, except in the case of obvious and recognizable errors.

4. Product availability

The availability of products indicated on the website may vary depending on inventory updates and simultaneous orders.

In case of total or partial unavailability of one or more ordered products, King S.r.l. will inform the Customer and may propose a replacement, a partial fulfillment, a voucher, or a refund of the amount already paid, if any.

5. Orders

The order submitted through the website constitutes a purchase proposal.

The contract is considered concluded when King S.r.l. accepts the order, including via email confirmation, order status modification, issuance of the tax document, or initiation of the shipment.

King S.r.l. reserves the right not to accept or to cancel orders in case of:

incomplete, incorrect, or unverifiable data;
unavailability of products;
obvious errors in prices or descriptions;
failure to authorize the payment;
suspected improper use of the website;
violation of these conditions;
failure to comply with the requirements provided by the applicable regulations.

6. Payment methods

The Customer can pay for the order using the methods available at checkout.

Payment methods may include, by way of example, credit card, bank transfer, PayPal, cash on delivery, or other enabled payment systems.

Some payment methods may be subject to conditions, amount limits, verifications, or authorizations by their respective service providers.

In case of failure to authorize the payment, the order may not be confirmed or may be canceled.

7. Invoicing

For each order, the tax document required by current regulations will be issued based on the data provided by the Customer.

The Customer is responsible for the correctness of the data provided during registration or ordering, including first name, last name, company name, tax code, VAT number, address, recipient code, or Certified Email (PEC), where required.

Any requests for modification of tax data must be communicated promptly and can be managed within the limits allowed by regulations.

8. Shipping and delivery

Delivery is made to the address indicated by the Customer during the order process.

The shipping and delivery times indicated on the website or communicated to the Customer are approximate and may vary due to causes not attributable to King S.r.l., such as courier delays, force majeure, holidays, strikes, weather events, or other unpredictable circumstances.

Upon delivery, the Customer is required to verify:

that the number of packages corresponds to what is indicated in the transport document;
that the packaging is intact, undamaged, not wet, and not altered.

Any anomalies must be reported immediately to the courier, accepting the goods with a specific written reservation.

In the absence of a specific reservation, King S.r.l. may not accept complaints regarding external damage or missing packages, unless otherwise provided by law.

9. Failed delivery, storage and rejection of the package

In case of absence of the recipient, incorrect address, failure to collect, rejection of the goods, or unreleased storage, King S.r.l. may charge the Customer for the costs incurred for shipping, return, storage, and order management.

If the order has already been paid, any refund may be made net of the costs incurred.

10. Right of withdrawal

The Customer has the right to withdraw from the purchase within 14 days from the delivery of the products, without having to provide any reason.

To exercise the right of withdrawal, the Customer must send a clear communication to:

The communication must indicate:

order number;
Customer's data;
products for which the withdrawal is intended to be exercised;
contact details for managing the procedure.

The Customer must return the products within 14 days from the communication of withdrawal, unless different instructions are provided by King S.r.l.

11. Return conditions

Returned products must be intact, unused, complete with original packaging, accessories, manuals, seals, and documentation.

For hygienic, sanitary, or health protection reasons, sealed products that have been opened after delivery, opened consumable products, liquids, flavorings, products containing nicotine, used devices, or products that are not suitable for resale cannot be returned.

The right of withdrawal is also excluded in the cases provided by law, including personalized, custom-made, perishable products, or products not suitable for return for hygienic or sanitary reasons.

Return costs are borne by the Customer, unless otherwise agreed or otherwise provided by law. The Customer is responsible for the return shipment until delivery to King S.r.l.

12. Refund

In the event of a validly exercised withdrawal, King S.r.l. will refund the amounts due within 14 days from receipt of the communication of withdrawal.

King S.r.l. may withhold the refund until receipt of the returned products or until proof by the Customer of having shipped them.

The refund will be made using the same payment method used for the purchase, unless otherwise agreed.

King S.r.l. may reduce the refund in case of a decrease in the value of the goods resulting from handling other than that necessary to establish their nature, characteristics, and functioning.

13. Legal warranty

The products sold are covered by the legal warranty provided by applicable regulations.

In case of a defective or non-compliant product, the Customer must contact customer service indicating:

order number;
affected product;
description of the problem;
photos or videos useful for the evaluation;
any available documentation.

The warranty does not cover defects or damage caused by:

improper or non-compliant use;
normal wear and tear;
shocks, drops, or accidental breakages;
tampering or unauthorized repairs;
use contrary to the manufacturer's instructions;
liquid infiltration;
lack of maintenance;
use of unsuitable accessories, chargers, or components.

King S.r.l. may request the return of the product for technical verification. If the product turns out to be functional or the defect is not covered by warranty, the costs of verification, management, and transport may be charged.

14. Use of data and communication to commercial partners

The personal data collected may be shared with partner companies with which King S.r.l. maintains commercial collaboration relationships, in order to efficiently manage relationships with customers, ensure the application of correct price lists, and improve sales processes.

In particular, personal data, contact details, shipping and billing addresses, Certified Email (PEC) addresses, and data relating to sales may be communicated to:

DEA Flavor S.r.l. will process the data as an independent data controller, for purposes related to the management of common commercial relationships and the definition of economic supply conditions.

The data communication takes place on the basis of the legitimate interest of the Data Controller, pursuant to art. 6, par. 1, lett. f) GDPR, to improve the management of the commercial network and ensure proper coordination with its partners.

No data communication is carried out for promotional or marketing purposes by the partner, unless explicit consent is given by the data subject.

The Customer's personal data are processed according to the privacy policy published on the website.

The Customer is invited to consult the privacy policy before proceeding with registration or sending the order.

16. Restrictions on the use of the website

The contents of the website cannot, either totally or partially, be copied, reproduced, transferred, uploaded, published, or distributed in any way without the prior written consent of King S.r.l., without prejudice to the possibility of storing them on one's own device or printing extracts solely for personal use.

The Smo-King logo present on the website is a registered trademark and cannot be used on websites, documents, communications, or other materials without the prior written consent of the trademark owner. All names and trademarks other than Smo-King are mentioned for informational purposes and belong to their respective owners.
